Terms of Service

The short version: our apps are licensed for personal use. Paid upgrades are clearly described before purchase, and current products use permanent one-time unlocks rather than subscriptions. A grown-up must make purchases for Child Fairy World.
1. Who we are
Kiwi Kettle is a trading name of Lokesh Sehgal, a sole proprietor based in India (“Kiwi Kettle”, “we”, “us” or “our”). We develop and publish software, including Child Fairy World and PickleCall, and operate kiwikettle.com. Contact us at james@kiwikettle.com.

Child Fairy World terms
About the app
Child Fairy World is an early-learning app for Android and Fire tablets. It offers guided tracing, spoken instructions, original songs and illustrated learning activities. Book 1, Learn the Alphabet, is included with the free download.
Grown-up responsibility
The learning experience is designed for children, but downloads, purchases, external links, sharing and support are for a parent, guardian, teacher or other responsible adult. These actions are protected by a grown-up gate. By purchasing, the adult confirms that they are legally able to enter into this agreement.
Paid books
Trace & Trail, Counting Adventure and Shapes & Colors may be purchased separately or as the Three-Book Adventure Bundle. Each is a permanent, non-consumable digital-content licence for personal and household use. There is no Child Fairy World subscription.
Paid content may require a first download while online. After a successful download, the content is designed to remain available offline on that device. Restoring access or moving to another device may require the same store account or the purchase method shown at checkout.
Educational scope
Child Fairy World supports practice and play. It is not a substitute for professional educational, developmental or medical assessment, and we do not promise a particular learning result.
PickleCall terms
About the app
PickleCall is a general-audience Android pickleball scorekeeper for users aged 13 and over. It helps users track scores, servers and court positions under common pickleball formats. Users remain responsible for confirming the rules that apply to their own match, club or competition.
Free version
Core scoring is free. The free version may show banner advertising on selected screens, but not on the live scoreboard. Availability of advertising and privacy choices may vary by age and region.
PickleCall Pro
PickleCall Pro is a permanent, non-consumable upgrade. It adds spoken score call-outs, on-device match history and statistics, and removes advertising. Pro is currently a one-time purchase with no recurring subscription. Voice availability depends on the text-to-speech voices installed on the device.
Your match data
Scores, player or team names, settings, match history and statistics are stored locally on the device. You are responsible for maintaining access to your device and any backups you choose to use.
3. Purchases, prices and payment
Current prices and included features are listed on our Pricing page. Depending on where you purchase, payment may be processed by Paddle, Google Play or the Amazon Appstore. The processor shown at checkout handles payment details, local currency, taxes and the transaction receipt under its own buyer terms.
For a purchase made through Paddle, Paddle acts as merchant of record. Kiwi Kettle receives the transaction information needed to deliver the product, provide support, prevent fraud and administer refunds. We never receive your full card number.
Access begins after the payment processor confirms a successful transaction. A pending, cancelled, refunded, reversed or unverified transaction does not grant or may remove paid access.
4. Refunds
Our Refund Policy forms part of these terms. Store purchases may need to be refunded through the store that processed them. Nothing in these terms limits rights that cannot legally be excluded.
5. Licence and acceptable use
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app and purchased content on compatible devices you control. You must not:
- copy, resell, redistribute, rent or sublicense an app or its content
- circumvent a purchase check, grown-up gate, security measure or access restriction
- reverse engineer the app except where applicable law expressly allows it
- use our characters, artwork, audio, branding or software to create derivative commercial products without written permission
- interfere with our checkout, verification services, website or other users
6. Intellectual property
Kiwi Kettle and its licensors retain ownership of the apps, code, characters, artwork, music, audio, text, designs and trademarks. Purchasing an app or unlock gives you a licence to use it; it does not transfer ownership of the underlying intellectual property.
7. Availability and changes
We work to keep our apps accurate and available, but devices, operating systems, app stores and third-party services change. We may fix, improve or discontinue features where reasonably necessary. We will not intentionally remove a paid permanent feature without providing a reasonable remedy where required by law.
8. Disclaimers and liability
The apps and website are provided “as is” and “as available” to the fullest extent the law permits. We do not guarantee uninterrupted or error-free operation. To the extent permitted by law, Kiwi Kettle is not liable for indirect, incidental, special or consequential loss. Our total liability for a claim concerning a paid product will not exceed the amount paid for that product, except where applicable law requires otherwise.
9. Ending use
You can stop using an app at any time by uninstalling it. We may suspend access where necessary to prevent fraud, comply with law or address a serious breach of these terms. Provisions concerning ownership, liability and disputes survive termination.
10. Governing law
These terms are governed by the laws of India, without excluding mandatory consumer protections that apply in your country of residence. Courts with jurisdiction under applicable law may hear disputes.
11. Changes and additional apps
We may update these terms and will change the date above when we do. Material changes affecting a paid product will be communicated where reasonably possible.
Other Kiwi Kettle apps. These terms currently provide specific guidance for Child Fairy World and PickleCall. App-specific terms and purchase guidance for other Kiwi Kettle apps will be published before those products are offered for sale.
